Dower and Curtesy

New York abolished dower prospectively, as of September 1, 1930. Curtesy was abolished much earlier. Despite advances in geriatric care, it is highly unlikely that these requirements will be of more than historical use in coming years.

Requirement

DOWR01 STG

Last owner (male) acquired prior to 911930

The wife of __(name)__, if he had any prior to September 1, 1930, must join with him in all instruments to release the inchoate right of dower. If the wife fails to join in the instruments, the marital status of said owner as of September 1, 1930 must be established by affidavit and proper disposition must be made of the question of inchoate dower.

Conveyance made after 9130, no wife joins, and

An interest in the fee of the premises herein was acquired by __(name)__ prior to September 1, 1930. Proof is required to show that __(name)__, the grantor in deed dated __/__/__, recorded __/__/__ in (Liber, Record Liber, Reel) ___ (C)p ___, was unmarried on September 1, 1930, or the question of inchoate dower of his wife must be removed as an objection to title. Disposition of this question can be made by (a) release of dower from the wife, or (b) proof of the death of the wife established, or (c) proof shown that the grantor died more than two years ago.

Where conveyance made in which female joins but

An interest in the fee of the premises herein was acquired by __(name)__ prior to September 1, 1930. Proof is required to show that __(name)__ and __(name)__, the grantors in deed dated __/__/__, recorded __/__/__ in (Liber, Record Liber, Reel) ___ (C)p ___, were husband and wife, or the question of inchoate dower of his wife must be removed as an objection to title. Disposition of this question can be made by (a) release of dower from the wife, or (b) proof of the death of the wife established, or (c) proof shown that the grantor died more than two years ago.
