Unincorporated Associations

Unincorporated Associations generally have difficulty owning land. Unincorporated union locals often set up a corporation to own real estate. Other associations are governed by the Benevolent Orders Law.

Requirement

Proof is required to show the names of the members of the association at the time of the conveyance and deeds are required from them or their successors in interest. Proof is required to show the names of the present members of the association, and deed is also required from all of them. Confirmation deed is required from the grantor in the above mentioned instrument.

Where title taken in a trade name used by one p

Deed dated __/__/__, recorded __/__/__ in (Liber, Record Liber, Reel) _____ (C)p ____ is made by __(name)__ to __(name)__, which is a trade name of __(name)__. A confirmation deed is required from the grantor in the above mentioned instrument or the grantor’s successor in interest.

Deed dated __/__/__, recorded __/__/__ in (Liber, Record Liber, Reel) _____ (C)p ____ is made by __(name)__ to __(name)__. This association (lodge, post, order) is one of the organizations named in section 2 of the Benevolent Orders Law. The following proofs are required:

(a) Proof is required to show that __(name)__ is a benevolent association (order, lodge, post) duly chartered as a subordinate (order, lodge, post, etc.) of the __(name)__, and that said charter is in full force and effect and has not been revoked or suspended.

(b) Proof is required to show that __(name)__ has duly qualified pursuant to Section 2 of the Benevolent Orders Law by electing three trustees and by filing the certificate of election with the Secretary of State.

(c) Proof is required to show that __(name)__ has duly qualified pursuant to Section 2 of the Benevolent Orders Law by electing three trustees and by filing the certificate of election with the Secretary of State.

(d) Proof is required to show that the sale of the premises herein has been duly authorized by the membership of __(name)__ at the meeting duly called in accordance with the constitution and by-laws thereof and the constitution and by-laws relating to membership meetings and to the property of the association must be submitted for examination to the Company.

Deed requirement

The deed on closing should be made in the name of the __(name)__, signed and acknowledged on its behalf by all the trustees and should recite that it is executed and delivered pursuant to the resolution of the membership at a meeting duly called for that purpose.

Where mortgage is to be made by an association
