There are special exceptions that are applicable in New York City.
Satisfactory Proof by affidavit must be furnished whether any work has been done upon the premises by the City of New York, or any demand made by the City for any work, which may result in charges being imposed by:
a. the New York City Department off Rent and Housing Maintenance, Emergency Services;
b. the New York City Department of Environmental Protection for Water Tap closing or any related work; and
c. by the New York City Department of Health;
whether or not such charges are liens against which this policy protects.
Satisfactory Proof by affidavit must be furnished showing whether any fee for an inspection, re-inspection, examination or service performed by the Department of Buildings or permit issued by the Department of Buildings have been levied, charged, created or incurred, which may become a lien upon the premises, whether or not such charges are liens against which this policy insures.
NOTE: The above two requirements are made due to the inability of this Company to search for record of these liens because of the failure of the City of New York to properly file or record notices of these charges. These charges are liens imposed pursuant to titles 17, 24 and 26 of the Administrative Code of the City of New York.
Redemption from In Rem
Proof is required that no application for redemption has been made within two years from the date of the deed from the Finance Administrator of the City of New York to the City of New York.
Resolution authorizing In Rem sales
Certified copy of the Resolution of the City Council authorizing the sale of the premises is required. If the transaction is not a sale at public auction, then the Company should be informed of the nature thereof, and, after proper searches are made, title will be recertified accordingly.
All items on the tax search must be paid or canceled on the tax records of the City Collector.
Transfer of Tax lien
The transfer of tax lien No. _______ held by __(name)__ must be marked as having been barred by proceedings In Rem on the tax records of the City Collector.

Survey of tax lot
Unless a survey of the tax lot is furnished, satisfactory to the Company, showing the lot in relation to the present streets and adjoining parcels, policy will not insure the accuracy of the dimensions and distances involved.
Sidewalk Violations in NYC

NOTE: This item will be excepted in the owner’s policy unless a Certificate of Dismissal has been obtained from the Department of Transportation or an appropriate escrow has been set. For the loan policy, this item has been provided for information only and will not appear as an exception in the mortgage policy. However, a failure to repair sidewalk or remove violation may result in a future lien against which the Policy will not protect. The exception may only be marked “omit” for the loan policy, if an appropriate escrow is taken by the Company, or a Certificate of Dismissal is obtained (see New York City Administrative Code Section 19-152).
