UNDERWRITING - Land Court Issues Memorandum Regarding Registered Land Guideline 14

Dear Associates:

The Chief Title Examiner of the Land Court recently issued a Memorandum relating to Land Court Guideline 14 - Death: The effect of Death upon Registered Land Titles. This recently issued memorandum supersedes a previous memorandum on the same topic. The new memorandum should be consulted in conjunction with Guideline 14 to ensure that documents presented for filing are accepted by the Land Court registration desk.    

It is important to note that per the memorandum, the Land Court will require FORMAL proceedings when filing a Complaint for Certificate After Death whether the decedent died testate or intestate.
