UNDERWRITING - Cook County Recording Changes

Dear Associates:

Effective immediately, the Cook County Recorder of Deeds has stated that the following documents will no longer be recorded.

  • Affidavits related to heirship, regardless of the document title
  • Deeds from heirs of a deceased owner as the grantor
  • Residential real estate contracts
  • Documents to be re-recorded to correct errors without a Corrective Affidavit signed by all parties to the document 

With regards to deceased owners, the recorder’s office is stating that they will record a court order determining heirship and a Notice of Probate and Release of Estate’s Interest.

It is not clear at this time if there are other documents that the recorder’s office will reject. Should you learn of any additional information from communications with the recorder’s office, please notify Julie Angelakos, Illinois State Counsel, at Julie.angelakos@stewart.com
